I. General Terms and Conditions
§ 1 Basic Provisions
- The following terms and conditions apply to contracts concluded between you and us as the provider (Rayana Jewellery) via the website http://www.rayanajew.com. Unless otherwise agreed, the inclusion of your own terms and conditions is expressly rejected.
- A consumer within the meaning of these terms and conditions is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. A business is any natural or legal person or a partnership with legal capacity that acts in the exercise of their trade, business, or profession when concluding a legal transaction.
§ 2 Conclusion of the Contract
1. The subject of the contract is the sale of goods.
2. By listing a product on our website, we make a binding offer to conclude a contract for the item under the terms specified in the item description.
3. The contract is concluded via the online shopping cart system as follows:
- The goods intended for purchase are placed in the “shopping cart.” You can review and make changes to the shopping cart at any time using the appropriate button in the navigation bar.
- After clicking the “Checkout” or “Proceed to Order” button (or similar label) and entering your personal details, payment, and shipping terms, a summary of the order details will be displayed.
- If you use an instant payment system (e.g., PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay), you will either be redirected to the order summary page in our online shop or to the instant payment provider’s website. After completing the necessary details, you will either return to our online shop or the instant payment provider will display the order summary.
- Before submitting the order, you can review and modify your details or cancel the order using your browser’s “back” function. By clicking the relevant button (“order with obligation to pay,” “buy now,” or similar), you make a legally binding declaration of acceptance, thereby concluding the contract.
4. The processing of the order and transmission of all required information for contract execution is carried out partially automatically via email. Ensure that the email address you provide is accurate and that technical receipt of the emails is not obstructed, especially by spam filters.
§ 3 Special Agreements on Payment Methods
1. Payment via “PayPal” / “PayPal Checkout”
When selecting a payment method offered via “PayPal” / “PayPal Checkout,” the payment is processed through the payment service provider PayPal (Europe) S.à.r.l. et Cie, S.C.A., (22-24 Boulevard Royal, L-2449, Luxembourg; “PayPal”). § 4 Retention of Title
1. You may only exercise a right of retention if it concerns claims arising from the same contractual relationship.
2. The goods remain our property until full payment of the purchase price.
§ 5 Warranty
1. Legal liability for defects applies.
2. As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects, and transport damage, and to notify us and the carrier as soon as possible. Failure to do so does not affect your legal warranty rights.
3. If a characteristic of the goods deviates from objective requirements, this is only considered agreed upon if you were informed of the deviation before placing your order and the deviation was explicitly agreed upon between the parties.
§ 6 Governing Law, Place of Performance, Jurisdiction
1. German law applies. For consumers, this choice of law applies only to the extent that it does not deprive them of mandatory protections under the law of their habitual residence (favorable principle).
2. The place of performance for all obligations and the jurisdiction is our registered office if you are a business, legal entity under public law, or public-law special fund. This also applies if you have no general jurisdiction in Germany or the EU, or if your residence or habitual location is unknown at the time of filing a lawsuit.
3. The provisions of the United Nations Convention on Contracts for the International Sale of Goods (CISG) do not apply.

We are not willing and not obliged to participate in dispute resolution procedures before consumer arbitration bodies.

3. Contract Language and Storage
1. The contract language is German.
2. The full text of the contract is not stored by us. You can print or save the contract details before submitting the order using the browser’s print function. Once the order is placed, the details, legally required information, and the terms and conditions will be emailed to you.
4. Essential Characteristics of the Goods or Services
The essential characteristics of the goods and/or services can be found in the respective offer.
5. Prices and Payment Terms
5.1. The prices indicated in the respective offers, as well as the shipping costs, represent total prices. They include all price components, including all applicable taxes.
5.2. The shipping costs are not included in the purchase price. They can be viewed via a specifically labeled button on our website or in the respective offer, are separately shown during the order process, and are to be paid by you, unless free shipping is promised.
5.3. If delivery is made to countries outside the European Union, additional costs that we are not responsible for may arise, such as customs duties, taxes, or money transfer fees (transfer or exchange rate fees of financial institutions), which will be borne by you.
5.4. Any transfer fees (transfer or exchange rate fees of financial institutions) incurred are to be borne by you in cases where delivery is made to an EU member state, but the payment was initiated from outside the European Union.
5.5. The payment methods available to you are indicated under a specifically labeled button on our website or in the respective offer.
5.6. Unless otherwise specified for individual payment methods, payment claims from the concluded contract are due immediately.
6. Delivery Conditions
6.1. The delivery conditions, delivery date, and any existing delivery restrictions can be found under a specifically labeled button on our website or in the respective offer.
6.2. If you are a consumer, it is legally stipulated that the risk of accidental loss and deterioration of the sold goods during shipment passes to you only when the goods are handed over to you, regardless of whether the shipment is insured or uninsured. This does not apply if you have independently commissioned a transport company or any other person to carry out the shipment who was not named by the entrepreneur.

The warranty for defects is based on the regulation "Warranty" in our General Terms and Conditions (Part I).
